1. Agreement to Terms
By creating an account or using RSYes (“the App”), you agree to be bound by these Terms of Service (“Terms”). RSYes is operated by Situfix Ventures LLC (“we,” “our,” or “us”). If you do not agree to these Terms, do not use the App.
The most current version of these Terms is always available at rsyes.com/terms-of-service. In the event of any discrepancy between this web version and the version displayed within the App, this web version shall control.
2. Eligibility
You must be at least 13 years old to use RSYes. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to terminate accounts that do not meet eligibility requirements.
3. Your Account
You are responsible for maintaining the security of your account and phone number. You are responsible for all activity that occurs under your account. You agree to provide accurate information when creating your profile. We reserve the right to suspend or terminate accounts that violate these Terms.
4. How You May Use RSYes
RSYes is designed to help you coordinate social events with friends. You agree to use the App only for its intended purpose and in compliance with all applicable laws. You may not:
- Use the App for any unlawful, harassing, or harmful purpose
- Impersonate another person or create a fake account
- Send spam, unwanted invitations, or commercial solicitations
- Attempt to access other users’ accounts or private data
- Reverse engineer, decompile, or tamper with the App
- Use automated systems (bots, scrapers) to access the App
- Interfere with or disrupt the App’s infrastructure
5. User Content
You retain ownership of the content you create (events, profile information, photos). By using the App, you grant us a limited, non-exclusive license to display and transmit your content as necessary to operate the service (for example, showing your event details to invited friends). You are solely responsible for the content you post and must not share content that is illegal, offensive, threatening, or that violates the rights of others.
6. Push Notifications and SMS
RSYes may send push notifications about event invitations, responses, and other app activity. You can manage notification preferences through your device settings. If you use the SMS invite feature, standard messaging rates from your carrier may apply.
7. Premium Features
RSYes may offer premium subscription features. Subscriptions are billed through Apple’s App Store or Google Play Store and are subject to the respective store’s terms and refund policies. You may cancel your subscription at any time through your device’s subscription settings. Cancellation takes effect at the end of the current billing period.
8. Intellectual Property
The RSYes name, logo, design, and all related trademarks, technology, and content (excluding user content) are the property of Situfix Ventures LLC and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.
9. Disclaimer of Warranties
RSYes is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure. We are not responsible for the actions, content, or conduct of other users, whether online or offline. You use the App at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law, Situfix Ventures LLC, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, without limitation, damages for loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless Situfix Ventures LLC, its owners, officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.
12. Termination
We may suspend or terminate your access to RSYes at any time, with or without cause, and with or without notice. You may delete your account at any time through the Account screen. Upon termination, your right to use the App ceases immediately. Sections 9 through 14 survive termination.
13. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in San Diego County, California. You agree to submit to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other means. Your continued use of RSYes after changes take effect constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
